What is Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal document that allows you (known as the donor) to appoint one or more trusted people, known as attorneys, who have your best interests in mind. Your attorneys are given legal authority to make decisions on your behalf and safeguard your interests concerning finances, health or welfare, particularly if you lose mental capacity or no longer wish to manage your own affairs. You decide whether they should act as soon as the LPA is registered, or only once you lose mental capacity.
There are two types of Lasting Power of Attorney in the UK. One type covers property and financial affairs like bills, bank accounts, etc. The other covers health and welfare, including medical treatment. Both need to be registered with the Office of the Public Guardian before they can be used.
Property & Financial Affairs LPA
A Property and Financial Affairs Lasting Power of Attorney allows you to appoint one or more trusted people to manage your financial affairs. Depending on the authority you grant, your attorney can help manage your bank accounts, pay bills, collect pension or benefits, buy or sell property, and make other financial decisions in your best interests.
Health & Welfare LPA
A Health and Welfare Lasting Power of Attorney allows you to appoint someone you trust to make decisions about your health and personal welfare if you lose mental capacity. This can include decisions about your daily care, living arrangements and medical treatment. If you choose to give them this authority, your attorney can also make decisions about life-sustaining treatment, ensuring your wishes are respected whenever possible.

FAQs About Lasting Power of Attorney Services
A Lasting Power of Attorney can only be used once they have been registered with the Office of the Public Guardian. A Property and Financial Affairs Lasting Power of Attorney can be used with your permission while you still have mental capacity. A Health and Welfare Lasting Power of Attorney can only be used when you are no longer able to make your own decisions.
A Lasting Power of Attorney can vary in cost, depending on the level of professional legal services involved in producing and validating the document. If you choose to prepare an LPA yourself, you’ll normally only pay the current Office of the Public Guardian registration fee (£92 per LPA at the time of writing). Professional fees apply if you choose to use an adviser.
You can nominate anyone as your attorney, provided they are over the age of 18 and meet the legal requirements when they are appointed. Most people choose a family member such as a spouse, partner, child or a relative who has their best interests at heart. You can also appoint a trusted friend or, if appropriate, a professional such as a solicitor acting in that capacity.
If you lose mental capacity without a Lasting Power of Attorney in place, your loved ones cannot automatically make financial or health decisions on your behalf. Instead, they may need to apply to the Court of Protection to become your deputy. This process can be more expensive, take longer and provide less flexibility than having an LPA already in place.
Yes. You can prepare your own Lasting Power of Attorney without using a solicitor. You will need to follow the guidance provided by the Office of the Public Guardian.
There is no expiry date on a Lasting Power of Attorney. It only comes to an end upon the death of the donor (the person for whom the LPA enables decisions to be made on behalf of). However, an LPA can also be cancelled by the donor should they no longer wish for it to come into effect.
A Lasting Power of Attorney replaced the Enduring Power of Attorney in England and Wales in October 2007. An LPA offers a comprehensive solution for an attorney to make financial, property and health decisions on behalf of the donor. LPAs replaced EPAs in 2007, though existing EPAs will remain legally enforceable if signed before 1st October 2007. Only LPAs can now be created.
